THOA 1994
The Transplantation of Human Organs Act 1994 is the primary legislation governing organ donation and transplantation in India. Amended in 2011 and 2014 to include tissue donation.
NOTTO
The National Organ & Tissue Transplant Organisation coordinates organ procurement, allocation, and registration of donors and recipients across India.
Brain Death Certification
Brain death must be certified by a panel of 4 doctors (including the treating doctor, a neurologist, and the hospital's medical superintendent) as per legal requirements.
Authorization Committee
For living donor transplants between non-relatives, an Authorization Committee reviews each case to prevent organ trafficking and commercialisation.

Legally, the family's consent is required at the time of organ retrieval. It is important to inform your family about your wish to donate so they can honour your decision.
Is there any cost to the donor's family?▼
No. All costs related to organ retrieval and transplantation are borne by the recipient or the transplant programme. The donor's family incurs no expense.
What is the difference between brain death and cardiac death?▼
Brain death is the irreversible loss of all brain function, including the brain stem, while the heart may still beat with life support. Cardiac death is when the heart stops permanently. Both can lead to organ donation.
Can I donate organs if I have a medical condition?▼
Many medical conditions do not prevent organ donation. Doctors evaluate each case individually at the time of donation. Even people with diabetes or hypertension may be eligible donors.
